Terms of Service

1. Acceptance of Terms

By accessing or using PhoneFluent ("the Service") at phonefluent.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including free trial and paid subscribers.

2. Description of Service

PhoneFluent is an AI-powered language learning platform that provides simulated phone conversation practice in Spanish. The Service includes AI voice calls, transcript generation, performance analysis, and feedback to help users improve their spoken Spanish fluency.

3. Account Registration

To use PhoneFluent, you must:

• Provide accurate and complete registration information
• Be at least 13 years of age
• Maintain the security of your account password
• Notify us immediately of any unauthorised use of your account

You are responsible for all activity that occurs under your account.

4. Free Trial

New users receive a 14-day free trial with up to 10 practice calls. The trial begins on the date of registration. No credit card is required for the trial. At the end of the trial period, access to new calls will be restricted until a paid subscription is activated. Trial call history and transcripts remain accessible after the trial ends.

5. Subscriptions & Billing

• Pro Monthly: $12.99 per month, billed monthly via PayPal
• Pro Annual: $142 per year, billed annually via PayPal
• Subscriptions automatically renew unless cancelled
• All payments are processed securely by PayPal
• Prices are in USD and may be subject to applicable taxes

6. Cancellation & Refunds

You may cancel your subscription at any time through your PayPal account. Upon cancellation:

• You will retain access until the end of the current billing period
• No partial refunds are provided for unused portions of a billing period
• Your call history and transcripts remain accessible for 30 days after cancellation

If you experience a technical issue that prevented you from using the Service, please contact us at hello@phonefluent.com and we will review your case.

7. Call Limits

Pro subscribers receive 25 practice calls per billing period. Unused calls do not roll over to the next period. Call limits reset at the start of each new billing period. Trial users receive 10 calls total during the 14-day trial period.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent call limits or access restrictions
• Use automated tools or bots to interact with the Service
• Share your account credentials with others
• Attempt to reverse engineer or extract the AI models used by the Service
• Use the Service in a way that could damage, disable, or impair it

9. Intellectual Property

The PhoneFluent name, logo, and all content on the Service are owned by or licensed to us. Your call transcripts and personal data remain yours. You grant us a limited licence to use your call data to provide the Service, including generating AI analysis and feedback.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated feedback will be perfectly accurate. PhoneFluent is a practice tool and is not a substitute for formal language instruction.

11. Limitation of Liability

To the fullest extent permitted by law, PhoneFluent shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months prior to the claim.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
